Some of the most important decisions made in relation to a case are made at the police station. If we are involved at an early stage of an investigation, we are often able to affect the outcome.

You are not obliged to say anything to the police and we advise all clients to maintain their right to silence until they speak with us.

You are entitled to have a solicitor present free of charge at any police interview. This is true for even the most trivial offences, e.g. a minor shop theft, assault, or damage.

You should never agree to be interviewed without legal representation.

If you know of the solicitor you want to use you should notify the officer of this immediately. Provided that you know the name of this firm this should be sufficient. That officer should then contact the Defence Solicitor Call Centre, who will contact us directly.

All criminal law cases have to start in the Magistrates Court which covers the area where the alleged offence or incident occurred.

The Magistrates Court is the lower level of the court system and generally deals with less serious offences such as motoring offences, low-value thefts and low-level assaults. All cases no matter how serious initially have to start out in the Magistrates court with some cases than going on to be completed in the Crown Court.

An interview under caution usually take place at either a Local Job Centre or Local Authority Offices if the Department for Work and Pensions (DWP) suspect that you have misled them about something on your initial claim form.

During the interview questions will be asked about your initial claim and any changes that may have occurred since the initial claim. Evidence that the DWP or Local Authority believe support their argument will be put to you. This evidence may include employee details, account details (bank statements), surveillance footage or witness statements. Other forms of evidence may be used but these are the most common.

Further investigations may follow an interview.

Timescales

In cases where the person pleads guilty and the case is dealt with at a single hearing, the whole case is usually completed within six months from the date of the offence.

VAT & Disbursements

Our fees and some of the disbursements are subject to VAT, which is currently set at 20% by the Government. Disbursements are the charges payable to third parties if any are engaged in your case and on your behalf.

The typical disbursements in a crime case are the fees payable to barristers or experts. The amount payable to third parties is dependent upon the amount of their involvement and their quotations will be obtained and communicated to you in writing before their engagement is made final in your case.

Our legal fees to represent you

Our fees are calculated on the basis of our solicitors’ hourly charging out rates – which are between £165 – £250 per hour depending on the experience and seniority of the solicitor conducting your case.

Where possible (depending on how apparent is the case information before us) we can offer you a fixed fee, for example, where the defendant is pleading guilty and the case is dealt with at a single hearing.

Our fixed fees are between £1750 to £2500 for this type of case where a plea hearing and one further/ final hearing is required.
